This Privacy Policy outlines how Careerforge collects, uses, and shares personal information when you interact with or use our Website or Services, as well as any personal information Careerforge collects offline in relation to the Services, which may be integrated with data from the Website and Services. By understanding this Privacy Policy, you will be informed about your privacy rights and choices.

In this document, "Careerforge" refers to Careerforge Inc. and all its subsidiaries, including Careerforge Payments, Inc. The term "Website" refers to www.careerforge.net, and "Services" encompasses the Website plus any websites, features, applications, widgets, or online services that are owned or operated by Careerforge and linked to this Privacy Policy.

Careerforge operates a marketplace as part of the Services, which involves platform information related to different participants in an interaction. Service users might be Clients, Contractors, Agencies, or Website Visitors, as defined in the User Agreement. This Privacy Policy governs the processing of personal information by Careerforge where it determines the purposes and means of such processing. It does not cover the processing of information by Users themselves, who may control the personal information they handle through the Services. A. Information You Provide to Us

When you engage with our Services, you may share with us personal details about yourself. This could include your name and contact details, financial information necessary for processing payments for services accessed through the Careerforge platform, or data required for us to assist with the completion of tax documents. As you use the Services, we may collect data on your interactions within the service and combine this with similar data from other users to enhance our Services. You might also share information about your contacts or friends, for instance, if you wish to invite them to a chat room. Additionally, Agencies may provide us with details about Contractors linked to the Agency. B. Non-Identifying and De-Identified Information Non-Identifying Information/Usernames

We may also gather additional information that does not directly identify you, such as postal codes, demographic data, details on how you use our Services, and general data related to your projects (“Non-Identifying Information”). We might aggregate this data from users of Careerforge, whether registered or not. Occasionally, we may transform Personal Information (typically, email addresses) into a type of Non-Identifying Information known in this Privacy Policy as “Hashed Information.” This usually involves using a mathematical process (known as a hash function) to encode information. Although this code does not directly identify you, it might be utilised by Careerforge’s partners to associate your activities and interests.

Combination of Personal and Non-Identifying Information: We may merge your Personal Information with Non-Identifying Information, and Careerforge will treat all such combined information as Personal Information.

De-Identified Information: We may also anonymise or aggregate data, converting it into non-personal information so that it can no longer be used to identify you (“De-Identified Information”). De-Identified Information may be used for any purposes outlined in the “We Use Information We Collect” section below. We will manage and utilise De-Identified Information in its anonymised form and will not attempt to re-identify the information, except to verify our de-identification methods or as required by law.

C. Information Collected Automatically

Similar to other online companies, we collect technical data when you access our Services. We utilise these technologies to analyse how individuals interact with our Services, enhance the functionality of our Website, preserve your login details for subsequent visits, and offer you advertisements that might interest you.

Careerforge and its partners employ cookies or comparable technologies to analyse trends, administer the Website, track user movements around the Website, the desktop app, and the mobile app, and gather demographic information about our user base overall. The technologies used to automatically collect data from Careerforge users may include cookies, web beacons, and embedded scripts. Additionally, our marketing partners, affiliates, analytics, and service providers may utilize various technologies (such as tags) to collect comparable information for security and fraud detection purposes, and we may engage third parties to perform these services on our behalf.

D. Work Diaries and Work View

With your consent, we collect data about a Contractor’s work for a Client, including automatically captured data about work on specific projects. If a Contractor enables Work Diaries, we will share these diaries with the pertinent Client and Agency. We notify Contractors whenever we capture information for the Work Diary and permit Contractors to block such data sharing.

As part of the Services, upon a Contractor's authorisation, we collect data about their work on a project for a Client, including data that may be regarded as personal information. This feature is referred to as Work Diary. Work Diaries consist of information supplied by the Contractor, such as memos, as well as automatically collected data about the project, such as the number of mouse clicks and keyboard strokes, and regularly taken screenshots (which may include a webcam picture of you if this feature is enabled in your settings). To use Work Diaries, you must download and install the Team App software from www.careerforge.net.

We share information from Work Diaries with the relevant Client and any manager or administrator from any associated Contractor Agency. We inform Contractors each time we gather data for the Work Diary. As stipulated in our Terms of Service, End User License Agreement, and help pages on the Website, a Contractor may choose to block or delete the screenshot and associated data for a recorded work interval, but then the Contractor may not be compensated for that work interval.

E. Analytics Providers, Ad Servers, and Similar Third Parties

We collaborate with advertising agencies and vendors who utilise technology to help us comprehend how people use our Website. These vendors may employ technologies to present you with advertisements that may be of interest to you. You have the option to opt out of receiving certain interest-based advertising.

Careerforge works with (or may work with in the future) ad networks, ad agencies, analytics service providers, and other vendors to provide us with information regarding traffic on the Service, including pages viewed and the actions taken when visiting the Service; to serve our advertisements on other websites, within mobile apps, and elsewhere online; and to provide us with information regarding the use of the Service and the effectiveness of our advertisements. Our service providers may collect certain information about your visits to and activity on the Service as well as other websites or services, they may set and access their own tracking technologies on your device (including cookies and web beacons), and may use that information to show you targeted advertisements. Some of these parties may collect Personal Information when you visit the Service or other online websites and services. We may also share certain Non-Identifying Information with these parties, including Hashed Information, in connection with the services they provide to us. If you wish to opt out of interest-based advertising from participating companies, click here (or if located in the European Union, click here). You must opt out on each device and each browser where you want your choice to apply. If you choose to opt out, please note you will continue to receive advertisements, but they may be less relevant to you.

While we may use a variety of service providers to perform advertising services, some of these companies are members of the Network Advertising Initiative (“NAI”) or the Digital Advertising Alliance (“DAA”) Self-Regulatory Program for Online Behavioral Advertising. You may also want to visit http://www.aboutads.info/choices/, which provides information regarding targeted advertising and offers an “opt-out” by participating companies in the DAA Self-Regulatory Program.

F. Do Not Track Signals and GPC

Please note that your browser setting may allow you to automatically transmit a “Do Not Track” signal to websites and online services you visit. Careerforge does not generally alter its practices when it receives a “Do Not Track” signal from a visitor’s browser. To find out more about “Do Not Track,” please visit http://www.allaboutdnt.com. Global Privacy Control (GPC) is a technical specification that you can use to inform websites of your privacy preferences regarding ad trackers. If you do choose to set up GPC, it may impact the functionality of the Website, but we honor the GPC signal on a per-browser basis automatically in your cookie preferences.

G. Children

The Service is designed for a general audience and is intended for users 16 and older. We do not knowingly collect Personal Information from anyone under the age of 16. If we become aware that a minor younger than 16 has provided us with Personal Information, we will take commercially reasonable steps to remove such information from our files. 2. USE OF DATA

We utilise the information gathered through the Services to deliver and enhance the Services, develop new products and services, process your requests, prevent fraud, provide you with relevant information and advertisements, comply with legal requirements, and for other purposes with your consent.

We Use Information We Collect:

  • To provide and enhance the Services, complete your transactions, respond to your inquiries, process your registration, verify the accuracy of the information you provide, and for compliance and internal business purposes.

  • To communicate with you through administrative messages, Careerforge newsletters, marketing or promotional materials (on behalf of Careerforge or third parties), and other information that may interest you. If you choose to stop receiving these communications from us, you can follow the instructions provided in the Your Choices and Rights section below.

  • To personalise the content and offers we show you, both within the Services and elsewhere online.

  • To manage and develop our business relationship with you, and, if applicable, the corporation or other legal entity you represent.

  • To evaluate your proposal for a freelance project with Careerforge and prepare related government and internal statistics reports.

  • To enforce and comply with the law, including conducting investigations, protecting the property and rights of Careerforge or a third party, ensuring the safety of the public or any person, or to prevent or halt activities we may deem or consider to be illegal, fraudulent, unethical, or legally actionable. We may also use Device Identifiers to identify Careerforge Users.

  • For purposes disclosed when you provide your information, with your consent, and as further outlined in this Privacy Policy.

  • To Honor Our Contractual Commitments to You. Much of our processing of personal information is to meet our contractual obligations to our stakeholders, or to take steps at Users' request in anticipation of entering into a contract with them.

  • For Our Legitimate Interests. Often, we process personal information on the basis that it furthers our legitimate business interests in ways that are not overridden by the interests or fundamental rights and freedoms of the affected individuals:

    • Providing our Website and Services.

    • Detecting security incidents, protecting against harmful, deceptive, fraudulent, or illegal activities, and prosecuting those responsible for such activities.

    • Measuring interest and engagement in our Services.

    • Short-term, transient use, such as contextual customization of ads.

    • Improving, upgrading, or enhancing our Services.

    • Developing new products and services.

    • Ensuring internal quality control and safety.

    • Authenticating and verifying individual identities.

    • Debugging to identify and repair errors in our Services.

    • Auditing related to interactions, transactions, and other compliance activities.

    • Enforcing our agreements and policies.

    • Analyzing and improving our business.

    • Communications, including marketing and responding to your inquiries about our services.

    • Addressing information security needs and protecting our Users, Careerforge, and others.

    • Managing legal issues.

  • To Comply with Legal Obligations. We need to use and disclose personal information in certain ways to fulfill our legal obligations.

3. DATA RETENTION

Unless you request that we delete certain information (see Your Choices and Rights below), we will only retain your personal information for as long as is necessary to fulfill the purposes for which it was collected, including to satisfy any legal, regulatory, accounting, or reporting requirements, as well as ongoing fraud prevention, backup, and business continuity purposes.

4. DATA SHARING AND DISCLOSURE

We do not sell your Personal Information for monetary consideration, nor do we share your Personal Information with third parties for their marketing purposes without first giving you the choice to opt-in or opt-out. However, we may use technologies on our Website to advertise or market to you and to understand your interaction with our advertisements. This could be viewed as a "sale" or "sharing" of personal information for targeted advertising under relevant data protection laws. We may also share information we have collected about you, including Personal Information, as disclosed when you provide your information, with your consent, as outlined in this Privacy Policy, or for the following business or commercial reasons:

  • Careerforge Users:

    • For Contractors who have signed a contract with a Client or who have opted to participate in Careerforge Payroll, we may share their information with Clients, Agencies, and Careerforge payroll providers. For Contractors who decide to view a job posting or submit a proposal through the Service, we may share their information with the relevant Client(s). For Contractors who have made their profiles publicly accessible, we may share their information with Clients, Agencies, Partners, and Developers.

    • Note that if a Contractor is suspended from the Careerforge Service, we may share that information with Clients for whom that Contractor has worked or submitted proposals. We may also share information with Agencies to which Contractors are linked for specific work projects.

    • For Clients who have entered into a service contract or agreed to use Careerforge Payroll with another user, we may share your information to complete the transaction or to aid in the resolution of a claim or dispute. The user receiving your information is prohibited from using it for purposes not related to the transaction, such as contacting you for marketing purposes, unless you have explicitly given your consent.

  • Service Providers:

    • We may engage service providers and individuals to support our Service, deliver the Service on our behalf, and perform Service-related tasks (e.g., maintenance services, database management, web analytics and online advertising, payment processing, fraud detection, and enhancement of Careerforge’s features) or to help us understand how our Service is utilised. These service providers may include analytics firms, advertising partners, payment processors, identity verification services, security firms, generative AI collaborators, or other vendors. These third parties may have access to your Personal Information so they can carry out these tasks on our behalf.

  • Generative AI Partners:

    • We enhance specific aspects of our Service by collaborating with trusted generative AI service providers. We may share the information you provide while using these features with these generative AI service providers, as well as additional information necessary to utilise the feature effectively.

    • Where Careerforge utilises this information to enhance features, we apply certain treatments to the data appropriate for the feature, including but not limited to, removing personal information and only using public data. Where a feature involves a generative AI service provider and requires the use of identifying information you submit to the feature, you have the option to either not use that feature or not opt-in to generative AI features more broadly.

    • The Service includes a dual-sided marketplace, which results in platform information pertaining to both parties involved in an interaction. For example, a Client’s review inherently involves a Contractor, a Client job post forms part of a Contractor’s work history, and Client spending contributes to a Contractor’s earning history. Therefore, if a Client or Contractor opts to use our generative AI features, the platform information associated with that user’s account—including the information described above—may be used to enhance those features, subject to limitations based on the choices of the other party involved.

  • Legal and Investigative Purposes:

    • Careerforge will share information with government agencies as required by law, including (without limitation) in response to lawful requests by public authorities to meet national security or law enforcement requirements and in connection with reporting earnings. We cooperate with government and law enforcement officials and private parties to enforce and comply with the law.

    • We will disclose information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal processes (including but not limited to subpoenas), or, at the request of governmental authorities or other third parties conducting an investigation where we determine in our sole discretion that the disclosure is necessary to (a) protect the property and rights of Careerforge or a third party, (b) protect the safety of the public or any person, or (c) prevent or stop activity we may consider to be, or pose a risk of being, illegal, fraudulent, unethical, or legally actionable activity.

  • Internal and Business Transfers:

    • Careerforge may share information, including Personal Information, with its parent company Careerforge Inc., and any current or future subsidiaries or affiliates, primarily for business and operational purposes, such as IT management, to allow them to provide services to you, or to support and enhance the services we provide. We may sell, transfer, or otherwise share some or all of our assets, including your Personal Information, in connection with a merger, acquisition, re-organisation, or sale of assets (including, in each case, as part of the due-diligence process with any potential acquiring entity) or in the event of bankruptcy.

  • Careerforge Foundation Initiative:

    • If you opt to participate in The Careerforge Foundation Initiative as a Contractor, we may share information pertinent to your involvement in the program with partners of Careerforge who provide support to Contractors through that program.

  • Sweepstakes, Contests, and Promotions:

    • ​We may offer sweepstakes, contests, and other promotions (any, “Promotion”) that may require registration.

  • Non-Identifying Information and De-Identified Information:

    • We may share aggregated Non-Identifying Information and may also disclose Non-Identifying Information (including, without limitation, Hashed Information) or De-Identified Information to third parties.

6. SECURITY

We implement several measures to safeguard your data, though no security system is infallible.

Careerforge takes reasonable steps to help protect and secure the information it collects and stores about Careerforge Users. We maintain appropriate administrative, technical, and physical safeguards designed to protect the personal information we hold from accidental, unlawful, or unauthorised destruction, loss, alteration, access, disclosure, or use.

7. CROSS-BORDER DATA TRANSFERS

As a Singapore-based company, we process and store your information in Singapore, although our service providers may process and store it in other locations.

Careerforge may transfer your personal information to third parties located in jurisdictions other than where your personal information was originally collected, including to countries that may not have been deemed to provide an adequate level of protection for the rights and freedoms of data subjects. If we do transfer your personal information to other jurisdictions, we ensure that the transfer is performed after thorough due diligence and that the data recipient is bound by contract to maintain appropriate technical and organisational measures at all times to prevent unauthorised or unlawful processing of personal information, as well as accidental loss, destruction, or damage to personal information, in line with our commitments under applicable data protection laws.
